Sexual harassment is any unwanted sexual behaviour that makes someone feel upset, scared, offended or humiliated. it can have a serious impact on their physical and mental health, and affect their life. We might have heard people talking about sexual harassment happening at the place of work, but it can happen any where and takes many form.
What the term SEXUAL HARASSMENT actually mean? And how do you know if something is sexual harassment?
SEXUAL HARASSMENT
According to definition under section 75 of the Bharatiya Nyaya Sanhita,2023-
(1) A man committing any of the following acts:
- (i) Physical contact and advances involving unwelcome and explicit sexual overtures,
- (ii) a demand or request for sexual favours,
- (iii) showing pornography against the will of a woman,
- (iv) making sexually coloured remarks; shall be guilty of the offence of sexual harassament.
PUNISHMENT FOR SEXUAL HARASSMENT
(2) Any man who commits the offence of sexual harassment specified in clause (i) or (ii) or (iii) of subsection (1) shall be punished with rigorous imprisonment for a term which may extend to three years or with fine or with both.
(3) Any man who commits the offence of sexual harassment specified in clause (iv) of subsection (1) shall be punished with imprisonment of either description for a term which may extend to one years or with fine or with both.
